Internships are a part of legal education in India because they provide law students with first-hand experience and exposure to the legal profession. The Bar Council of India makes internship a part of the law courses and states clearly that they are essential in preparing law students to practice a legal profession. In this article, legal aspects of an internship and how law students approach the practical side of an internship are discussed.
Legal Requirements for Internships
The Bar Council of India requires all registered students of law to complete a minimum number of weeks of internship during their studies. For three-year law courses, students have to complete a minimum of 12 weeks of internship, while students pursuing five-year integrated law courses have to complete 20 weeks[1]. The internships may be completed in various forums of law like trial courts, advocates' chambers, judiciary, research institutions, legal regulatory authorities, NGOs, corporate houses, and law firms.
Important Principles:
Practical Problems Faced by Law Students
While there are benefits to internships, law students typically encounter the following practical problems:
1. Getting Internships
Securing the perfect internship may be competitive, particularly in leading law firms or government agencies. Students have to apply early and prepare themselves according to eligibility requirements, including academic performance and appropriate skills.
2. Balancing Internships and Academics
Internships are sometimes full-time, and the school term does not allow for it. Students must be diligent in time management to juggle internship responsibilities with coursework.
3. Financial Limitations
Most internships, and especially government or non-profit internships, offer little or no stipend, and thus it is hard for students financially. This may discourage students who are unable to afford unpaid internships.
4. Limited Feedback and Direction
Others may provide very little direction or feedback, so the students do not have clear guidance on how to proceed or improve themselves in the legal profession.
Overcoming Challenge and Maximizing Internship Experience
To overcome these challenges, law students can employ several strategies:
